Compensation for Injuries Caused by Childhood Vaccines
If you or your child was injured by a vaccination, the road to recovering financial compensation for damages is legally very different from cases involving other types of medical malpractice.
Cleveland's Vaccine Injury Claim Lawyers
Instead of suing the doctor, nurse, clinic or the maker of the vaccine, your claim must be submitted to the National Vaccine Injury Compensation Program (VICP). Not every lawyer is experienced with recovering compensation from the VICP. The attorneys of Mishkind Law Firm Co., L.P.A., are. We have successfully represented clients in vaccine injury claims since VICP was established in the 1980s.
Vaccines covered by the VICP are:
- Diphtheria, tetanus, pertussis (DTP, DTaP, TDap, DT, Td, or TT)
- Haemophilus influenzae type b (Hib)
- Hepatitis A (HAV)
- Hepatitis B (HBV)
- Human papillomavirus (HPV)
- Influenza (TIV, LAIV) (given each year during the flu season)
- Measles, mumps, rubella (MMR, MR, M, R)
- Meningococcal (MCV4, MPSV4)
- Polio (OPV or IPV)
- Pneumococcal conjugate (PCV)
- Rotavirus (RV)
- Varicella (VZV)
- Any combination of the vaccines above
Additional vaccines may be added in the future. Currently, injuries caused by the 2009 H1N1 vaccine are not covered by the program.
The National Vaccine Compensation Act (NVCA) established the VICP as a no-fault alternative to litigation for people injured by vaccines. It limits the injured party's compensation for pain and suffering to $250,000. You can also recover for financial costs associated with the injury that are not covered by insurance.
We have represented clients whose children suffered seizures and other neurological damage after being vaccinated, as well as adults who developed arthritis because of a vaccine. It is not always obvious that a vaccination caused an injury. Because of our long experience in medical malpractice and vaccine injury claims, we may be able to establish a connection between a medical issue and a vaccine.
