Claim was pursued under the National Vaccine Injury Compensation Program, 42 U.S.C. Section 300aa-10 to 34. Case settled for a lump sum payment for pain and suffering of $165,000.00. Maximum award possible for pain and suffering under the program is $250,000.00 reduced to present value. No lost income or ongoing medical expenses. Attorney Fees and cost of litigation are paid as a separate award determined by the United States Court of Federal Claims and do not reduce the amount that the plaintiff receives.

Description of Case: Plaintiff received a tetanus and diphtheria toxoid, and sustained an injury set forth in the Vaccine Injury Table, to wit, a brachial neuritis; the onset of a severe aching pain occurring approximately five days after the aforementioned administration of the vaccine. The symptoms of her brachial neuritis are confined to the upper extremity without involvement of other peripheral nerve roots or central nervous system structures. Claim was pursued under the National Vaccine Injury Compensation Program, 42 U.S.C. Section 300aa-10 to 34. In addition to the settlement amount paid to the Plaintiff, attorney fees and costs were paid for directly by the U.S.
