The Vaccine Injury Compensation Program (VICP) mandates that only certain vaccines are covered. Claims are filed by way of a petition in the United States Court of Federal Claims and assigned to a Special Master who serves as the judge of the claim. The claim is assigned to a lawyer in the Department of Justice who represents the Secretary of Health & Human Services. If it’s determined that the injuries were caused by a vaccination, compensation will be awarded to the injured person or, when a death occurs, the estate. There are certain qualifications that must be met in order to be eligible for compensation. Numerous injuries qualify.

Recently, Guillain Barré Syndrome caused by the flu vaccination and Shoulder Injury Related to Vaccine Administration (SIRVA) have been added to the Vaccine Injury Table. If the vaccine is listed in the Vaccine Injury Table (42 CFR 100.3) and the patient develops Guillain Barré Syndrome (GBS) and shoulder injuries arising from administration of a given vaccine (SIRVA injuries), it is presumed that the injury is subject to the National Vaccine Injury Compensation Program. Other vaccines and related injuries need to be proven through expert testimony.
