Vaccine Injury Lawyers – We Handle Cases That Other Lawyers Won’t
If you or a loved one has been injured by a vaccination, you may be entitled to compensation. Rather than filing a lawsuit against the doctor, pharmacy or pharmaceutical company that was responsible for the vaccine, you have a less stressful option. Howard Mishkind of Mishkind Kulwicki Law Co., L.P.A. in Cleveland, has handled vaccine injury claims since 1990 for injured persons that live in Ohio and throughout the country. Mr. Mishkind was first licensed in the United States Court of Federal Claims (previously known as the United States Claims Court) in 1990 and has represented children and adults that have suffered injuries that occurred shortly after a vaccination. He has experience in handling death claims associated with serious complications following a vaccination, as well as injuries that have caused various physical and mental injuries to children and adults.
Recently, David Kulwicki, a partner in Mishkind Kulwicki Law Co., L.P.A., became licensed in the United States Court of Federal Claims and joins Mr. Mishkind in handling vaccine injuries for persons that believe they have been injured due to vaccines.

What Our Vaccine Injury Attorneys Can Do For You
Our vaccine injury attorneys are licensed and qualified to handle injury claims, whether the vaccination occurred in Ohio or anywhere within the United States. The Vaccine Injury Compensation Program (VICP) mandates that only certain vaccines are covered. The VICP was established in 1986 in an effort to award compensation to individuals who suffer injuries, or their loved ones in the event of a death caused by a vaccination. Unlike civil litigation, the Program was established to allow for compensation under certain circumstances and to avoid the necessity of suing a doctor, pharmacy or pharmaceutical company.
Claims are filed by way of a petition in the United States Court of Federal Claims and assigned to a Special Master who serves as the judge of the claim. The claim is assigned to a lawyer in the Department of Justice who represents the Secretary of Health & Human Services. If it’s determined that the injuries were caused by a vaccination, compensation will be awarded to the injured person or, when a death occurs, the estate. There are certain qualifications that must be met in order to be eligible for compensation. Numerous injuries qualify.
Recently, Guillain Barré Syndrome caused by the flu vaccination and Shoulder Injury Related to Vaccine Administration (SIRVA) have been added to the Vaccine Injury Table. If the vaccine is listed in the Vaccine Injury Table (42 CFR 100.3) and the patient develops Guillain Barré Syndrome (GBS) and shoulder injuries arising from administration of a given vaccine (SIRVA injuries), it is presumed that the injury is subject to the National Vaccine Injury Compensation Program. Other vaccines and related injuries need to be proven through expert testimony. If the attorneys at Mishkind Kulwicki Law accept your case and pursue the claim, they will petition the court for lawyer fees and costs Those fees and costs are paid by a special fund. They do not come out of the award of compensation for your vaccine injury claim.
Some of the injuries that have been reported and have been investigated by our office include brachial neuritis, encephalitis, encephalopathy, Guillain Barré Syndrome, Shoulder Injury Related to Vaccine Administration (SIRVA), transverse myelitis and other vaccine-related injuries. This list is certainly not exhaustive and is for illustration purposes only. There are many other injuries caused by vaccines. If you believe that you or a loved one has been injured by a vaccine, but do not have a diagnosis, you still may be eligible for compensation, so please contact us to evaluate your case. We will get your questions answered.
By far, the most prevalent claims brought under the Vaccine Injury Compensation Program relate to the measles, mumps and rubella (MMR) vaccine, the varicella virus vaccine, the seasonal influenza vaccine, hepatitis A vaccine, hepatitis B vaccine, the human papillomavirus vaccine, diphtheria tetanus toxoid and meningococcal vaccine. There are very few lawyers that are qualified to prosecute vaccine injury cases, and we are honored to be among the few that have handled claims for deserving families and individuals.
