Shoulder Dystocia – Brachial Plexus Injury to Newborn

Settlement Amount: $500,000.00
Settlement Date: 7/2003
Attorney: Howard D. Mishkind

Description of Case: At birth, Baby Boy Doe weighed 9 pounds and 13 ounces. His delivery was complicated by right shoulder dystocia that was managed in a substandard manner resulting in a severe and permanent right brachial plexus injury.
During his delivery, labor and delivery room nurse violated the standard of care by inappropriately applying fundal pressure, causing Baby Boy Doe’s shoulders to become trapped. Following the shoulder dystocia, Defendant doctor applied excessive lateral traction to Baby Boy Doe’s head and neck in an effort to deliver his body.
