Description of Case: 84-year-old Alzheimer’s patient admitted to ABC Nursing Home. Shortly after his admission, the resident was assaulted by a nurse’s aid when the nurse’s aid attempted to assist the resident in showering. Patient did not require any medical treatment and the assault did not factor into any physical complications to the resident. The nurse’s aid was fired by a nursing home and prosecuted for patient abuse. The family was not notified of abuse until after decedent died four months later of unrelated causes. The plaintiff’s claim was based upon a violation of the patient bill of rights, common law negligence, and violation of Ohio Consumer Protection Act.
